Consistent with our emphasis on teamwork and efficiency, we avoid rigid "practice groups" that can cause lawyers to lose perspective that clients require. Rather, KFP taps different practice skills for the different types of matters we handle. We have four specialties: Litigation, Arbitration, Program Design and Management, and Legal Consulting. We apply those practice specialties in various substantive areas of expertise, including Insurance, Reinsurance, Banking, Commercial and Tort.

Practice Specialties

Litigation Our lawyers have handled hundreds of lawsuits in the federal and state trial and appellate courts around the country. In our home jurisdiction of Northern Illinois, we appear frequently in the federal district court, the Seventh Circuit Court of Appeals and in the Circuit Court of Cook County, particularly the Law and Chancery Divisions.
Arbitration KFP lawyers have deep experience with domestic and international arbitration proceedings and associated litigation, including motions to compel arbitration and suits for injunctive relief in aid of arbitration. We have utilized several arbitration associations, including the American Arbitration Association and ARIAS. Our lawyers have participated in the ARIAS program to train reinsurance arbitrators.
Program Design and Management At KFP, we routinely help clients design and manage custom insurance programs involving various lines of coverage. We counsel clients on the risks inherent in the line of coverage, identify risks the client does not intend to assume, draft manuscript policy forms and applications, manage claims, analyze coverage defenses, recommend reserves and claim-resolution strategies, and protect clients' rights in coverage litigation or arbitration. We also pursue subrogation claims and other third-party recovery.
Legal Consulting Like our clients, KFP recognizes that an ounce of prevention can be worth a pound of cure. We have an active and sophisticated consulting practice advising our clients on proactive strategies to minimize legal exposure in the future. We advise our clients in diverse areas, such as healthcare liability, insurance policy and reinsurance treaty drafting, financial product development, regulatory compliance, corporate organization and litigation management. We negotiate business resolutions when appropriate as an efficient alternative to litigation.

Substantive Expertise

Insurance KFP lawyers comprehensively serve the insurance industry in many lines of business, including general liability, fidelity and surety, directors and officers liability, errors and omissions, employment practices liability, managed care professional liability and medical professional liability. Our practice includes policy drafting, program management, litigation management, insurance coverage litigation and arbitration and subrogation.
Reinsurance Our lawyers have great experience with reinsurance in diverse lines, including specialized areas such as finite risk and stop loss. We have arbitrated and litigated reinsurance disputes for clients in the U.S. and abroad. We represent clients in disputes over complex insurance and reinsurance programs concerning liability of cedents, reinsurers, intermediaries, TPAs and brokers.
Banking Our banking practice spans the spectrum of the banking industry an emphasis on retail banking and inter-bank disputes. We have a particular expertise in payments and the Uniform Commercial Code, especially Articles 3, 4, 4A and 9, and issues relating to bank and wire fraud and fidelity insurance.
Commercial Our lawyers have a broad base of commercial law experience addressing a variety of contracts, security agreements and other loan documents, real estate, leases and government regulations. KFP uses this substantive legal knowledge to resolve business issues through negotiations, work-out arrangements and, if necessary, litigation.
Tort KFP also handles business tort litigation, including interference with contract or economic advantage, consumer fraud, unfair competition and related areas. We also represent individual tort victims to pursue intentional tort claims.
Healthcare Our lawyers have extensive healthcare liability experience, including the direct defense of healthcare providers and the management of claims against health insurers and managed care organizations nationwide.
